Malacañang Talks About 'e-Martial Law'


There will be no 'e-martial law' despite the effectivity of the anti-cybercrime law today according to Presidential spokesperson Edwin Lacierda.

In Willard Cheng's report posted at ABS-CBNnews.com, the Malacañang assured that civil liberties guaranteed under the Constitution will be protected despite the effectivity of the anti-cybercrime law.

Lacierda stressed that the government has not moved to “deprive anyone of access to the Internet or to suppress civil liberties as exercised online,” turning the tables instead on hackers that have defaced government websites. 

In fact, what has taken place is that hackers who claim to be aligned with critics of the Cybercrime Act are the ones who have engaged in online vandalism, depriving the broader public of access to much needed government information and services online,” Lacierda said.

The Palace appealed to critics to refrain from hacking government websites, saying there are people who may not be able to access needed information.

Lacierda asked other critics of the law to denounce the hacking.

“‘Yung mga ginagawa ng mga hacktivist, akala nila nakakatulong sila pero ang laki ng epekto nila sa mga taong kailangan pang bumiyahe. Kaya nga tayo may online, may website para makita na po ng ating mga taumbayan kung anong mga pangangailangan, anong mga requirements, for instance, sa isang dapat gawin or makikipagtransaksyon sa gobyerno,” Lacierda said.

Ang ginagawa nilang pagde-deface, pagha-hack po sa website ay nakakaapekto po sa nakakarami. And that’s the reason why we asked… those… against the cyber crime law to also denounce this acts. Kasi for the many people who require or need the information from the websites, napupuwerwisyo po sila, it prejudices them,” he added.

The Palace welcomes instead moves to question the constitutionality of the law through legal means in the Supreme Court and a reported plan of legislators to introduce amendments to the law.

We welcome it. That’s part of the legal and constitutional processes that continue,” Lacierda said.

Lacierda assured the government will be “judicious” in implementing the law.

We will be judicious because we are fully cognizant of the constitutional rights of people. We will work within the ambit of the Constitution. That is our guarantee to all the people,” Lacierda said, echoing a statement of Justice Secretary Leila de Lima.

Lacierda also dismissed criticisms that the government is out to implement an “e-Martial Law.”

Today is the first day of the implementation of the law, we have all the papers saying stop e-Martial Law. There is freedom of expression… We have not stopped anyone from expressing their concerns,” Lacierda said.

The Palace continues to stand by the law, saying that it serves to address “legitimate concerns about criminal behavior on the Internet and the effects of abusive behavior.”

We are concerned with freedom of expression but for a website that falsely claims, for instance, you… have AIDS how does one address that? It’s definitely damaging to [your] reputation,” Lacierda said. “There will be instances where abuses on the expression will be done. So how does one correct that?

The Official Gazette has uploaded on its website transcripts of the Senate deliberation on the Cybercrime Prevention Act of 2012 “from the time it was sponsored by Senator [Edgardo] Angara up to the discussions on the bicam report.”

Lacierda said there has been misinformation on some details about the law, including when the provision on online libel was inserted.

Online libel was inserted by Senator [Tito] Sotto in the Senate deliberation. The takedown clause was also inserted during the Senate deliberation for the record. However, the penalty on the libel provision was inserted in bicam. That’s why there has been misinformation on that point that’s why we are clearing out,” Lacierda said.

The Palace is urging all stakeholders to participate in a dialogue as the government crafts the implementing rules and regulations of the law.

GMA Network prevailed over rival stations in nationwide TV ratings last September according to the industry’s more trusted ratings provider, Nielsen TV Audience Measurement.

Based on full September data (September 23 to 30 based on overnight data), GMA posted an average total day (6 AM to 12 MN) audience share of 34.1 percent in National Urban Philippines (NUTAM), leading ABS-CBN’s 32.9 percent by 1.2 points, and TV5’s 15.7 percent by 18.4 points.

More television viewers also tuned in to GMA across all dayparts (morning, afternoon and evening inclusive of primetime) in the important areas of Urban Luzon and Mega Manila, where the bulk of urban television households are found.

In Urban Luzon, which accounts for 77 percent of the total urban TV households nationwide, GMA reigned supreme with a 38.2 percent total day audience share, 9.7 points higher than ABS-CBN’s 28.5 percent, and 23.2 points higher than TV5’s 15 percent.

GMA likewise ruled in Mega Manila, which represents 59.5 percent of rural TV households in the country, after generating a 39.2 percent total day audience share, while ABS-CBN trailed behind by 12.6 points with only 26.6 percent. TV5 lagged father behind by 23.4 points with only 15.8 percent.

Leading across all areas, GMA continues to reinforce its strong showing in the afternoon block (12NN to 6PM), scoring double-digit margins over other networks. GMA registered an afternoon audience share of 38.7 percent in NUTAM, considerably ahead of ABS-CBN’s 25.1 percent, and TV5’s 16.3 percent.
In Urban Luzon, GMA’s afternoon block scored 43.3 percent, zooming ahead of ABS-CBN’s 20.6 percent, and TV5’s 15.2 percent. Likewise, in Mega Manila, GMA registered a commanding 44.1 percent afternoon audience share, leaving ABS-CBN behind with only 19.0 percent, and TV5, which managed only 16.0 percent.

GMA dominated the top programs lists in Urban Luzon and Mega Manila with 18 and 20 Kapuso programs making it in each list, respectively.

Among the top-rating GMA programs in both lists are GMA’s banner newscast 24 Oras, the recently concluded GMA drama Makapiling Kang Muli, GMA Telebabad’s One True Love and Luna Blanca, the country’s longest running noontime show Eat Bulaga, and consistent weekend top-rater Kapuso Mo, Jessica Soho (KMJS). KMJS was also the number one program in Mega Manila.

Newly-launched GMA shows Pepito Manaloto: Ang Tunay na Kuwento, the sequel to the top-rating reality sitcom starring Michael V. of the same title, and Aso ni San Roque, the latest addition to the Network’s primetime block headlined by Kapuso child star Mona Louise Rey, also made it to the top 30 highest rating programs lists in NUTAM, Urban Luzon, and Mega Manila.

GMA subscribes to Nielsen TV Audience Measurement along with 22 other paying subscribers including another local major television network, TV5, Faulkner Media, CBN Asia, 15 advertising agencies, and 4 regional clients.

Nielsen has a sample size of 1,190 homes in Mega Manila versus Kantar Media’s 770 homes. Nielsen also has a nationwide sample size of 2,000 homes compared to the lower sample size of 1,370 utilized by Kantar Media.

ABS-CBN continued to dominate nationwide TV viewing across urban and rural homes in September 2012 with an average national audience share of 42%, or ten points higher than GMA’s 32%, according to data from Kantar Media.

Kantar Media uses a nationwide panel size of 2,609 urban and rural homes, more than AGB Nielsen’s 1,980 homes that are only based in urban areas. Kantar Media’s panel represents 100% of the total Philippine TV viewing population, while AGB Nielsen reportedly represents only 57% of the Philippine TV viewing population.

A recent Kantar Media study also revealed that there are differences in the viewing preferences between urban and rural homes that will be important for advertisers in making ad placement decisions.

Data also show that ABS-CBN ruled total day viewing from June to September this year with an average national audience share of 42% versus GMA’s 31%. Kantar Media launched its expanded TV ratings measurement to include rural homes in June this year. ABS-CBN also dominated viewer-rich primetime (6PM-12MN), when most Filipinos watch TV and advertisers put a larger chunk of their investment in to reach more consumers efficiently , with a national audience share of 49% in the four-month period, or a whopping 21-point lead versus GMA’s 28%.

Meanwhile, for the month of September, more households tuned in to ABS-CBN’s primetime block that registered a national audience share of 48% or 18 points higher than GMA’s 30%. ABS-CBN also ruled primetime viewing in Luzon where it hit an average audience share of 43% versus GMA’s 33%; in the Visayas with 55% against GMA’s 26%; and in Mindanao with 62% or more than three times bigger than GMA’s 18%.

Out of the top 15 top running programs in September, ABS-CBN took 13 spots and secured the top 10 spots. Royal teleserye “Princess and I,” which Filipinos followed until Mikay (Kathyrn Bernardo) was finally revealed to be the long lost princess of Yangdon, is now the most watched program in the country with a national TV rating of 37.7%.

“Walang Hanggan” enjoyed a whopping 36.6% national TV rating, while weekend programs “Wansapanataym” and “Maalalala Mo Kaya” claimed the third and fourth spots in the top 15 most watched programs, both hitting a national TV rating of 33.8%.

“TV Patrol,” the only newscast to make it to September’s top 15 programs, also remained as the Philippine’s number one newscast with an average TV rating of 32.5% or nine points higher than GMA’s “24 Oras” (18.1%), while “Aryana” steadily climbed to 24.5% from last month’s 22.2%.

Other top Kapamilya programs include “Kapamilya Deal or No Deal” (26.8%), “Rated K” (25.9%), “Goin’ Bulilit” (23.2%), “Be Careful With My Heart” (22.9%), “Lorenzo’s Time” (19.6%), “Sarah G. Live” (19.4%), and “The X Factor Philippines Saturday” (18.7%).

ABS-CBN registered a net income of P2.4 billion for the full year 2011, while news media reported that GMA Network net income plummeted to P1.72 billion in the same period.

ABS-CBN shifted to Kantar Media/TNS after filing a case vs. AGB Nielsen Media Research for failing to comply with its request to investigate alleged cheating and data tampering in TV ratings. The case is still pending in court contrary to claims by GMA, which is not a party to the case, that it has been resolved.

Singer - songwriter - theater actor and now being tagged as “Sexy Soul/Jazz Artist” Markki Stroem may have been introduced via the talent show Pilipinas Got Talent years ago, but it was last year that the public realized how gifted he is as a musician when he released an original song and music video online and on MYX “Steal Your Soul”, easily topped the charts and stayed there for couple of months. The song highlighted the distinct sound of Markki and unique songwriting style.

Because of the favorable response the song received, he was given the chance to star in a concert “Make Me Sweat” last February in Music Museum with the G-Force and now released his much awaited debut album “Thousands of Pieces” produced by Cornerstone Music. The CD includes his carrier single - a jazzed-up cover of Carley Rae Jepsen’s hit song “Call Me Maybe”, which is currently becoming a big radio hit. Markki also gave Britney Spear’s “Toxic” an exciting twist which is definitely a surefire hit once released.

But more than the covers featured in the album, it underscores Markki’s gift of writing music. Original songs written and arranged by Markki himself depict various state of the heart, relationships and life. “Kung Pwede Lang Ibalik”, “Illicit Activities”, “Fall From Grace”, “Iron Curtain” and “Exchanging Glances”.

I really consider this my ‘baby’ because I have been a part of the whole creative process,” says Markki. “I am very thankful that I was given this chance to work on a very personal album like this.” He also added that he is mighty thankful that he got to work with some of the most artistic people in the business – singer Zia Quizon, production house Generation M and his own band.




Being part of the ASAP 2012 family, the show launched his album last September 23 and another single’s music video “Thousands Of Pieces” (the album’s title track) was premiered on MYX featuring the Goddess of Cosplay Alodia Gosiengfiao and Pinoy Big Brother Unlimited Big Winner Slater Young.

Markki’s versatility is undeniable. Aside from being a musician, he is also currently working on two big projects which will be shown before the year ends. He will be playing the character of Joe Jonas in “Camp Rock” the musical and will portray a different and very exciting role (one of the lead casts) in an independent film “Slumber Party” – a Cinema One Originals entry. Not to mention his most talked about walk in the recently concluded Cosmopolitan Bachelor Bash as one of the Top 10 hottest men.




On October 5, Friday, Cornerstone Music, Magic 89.9 and Bonifacio Global City (BGC) will stage Markki’s grand album launch at the Bonifacio High Street Activity Area at 7 pm with his amazing band and some special guest performer/s. Kapuso singer and actress Frencheska Farr first admitted that she got scared in giving justice to Dulce’s role because of the depth of the diva’s character and story.

But that did not stop her from performing her best. Instead, she took it upon herself to bring out the most moving act and deliver the most convincing lines she could ever show.

I was challenged with the role and I really want to give it my all. Even though I haven’t experienced all those painful moments in my life yet, I still want to do good,” says Frencheska.

It’s going to be a toss up among the Boys, the Girls, and the Groups as “The X Factor Philippines” contestants Gabriel Maturan of Dipolog City, KZ Tandingan of Digos City, and Daddy’s Home of Metro Manila made it to the final three of the country’s biggest musical event and will compete for the grand title in the much-awaited grand finals this Saturday (Oct 6) and Sunday (Oct 7) at the PAGCOR Grand Theater in Paranaque.  

The highly-anticipated final musical showdown will also witness the battle of judge-mentors Martin Nievera, who mentors the Boys; Charice for the Girls; and Gary Valenciano for the Groups. Before the excitement this weekend, “The X Factor Philippines” went through an intense drama after Charice’s other mentee from the Girls, Allen Sta. Maria, ended her ‘x factor’ journey at a close fourth spot and got the boot last Sunday (Sep 30). All three mentors, except Charice, voted to send Allen home and preferred for KZ, who joined her in the bottom two, to stay in the competition. Charice was spared from choosing between her two girls but bursted into tears when she bid one of her mentees goodbye. 

The battle stage is already set for the final three. Who will among Gab, KZ, and Daddy’s Home will emerge as the first “The X Factor Philippines” grand winner? DoJ Implements Cybercrime Prevention Act Law Starting October 2, 2012 



The much-questioned Cybercrime Prevention Act Law of 2012 will be implemented starting today as confirmed by Department of Justice (DoJ) Secretary Leila De Lima unless it is declared unconstitutional by the Supreme Court (SC).

De Lima said: 
Right now we have the law and it is our duty to implement it unless declared unconstitutional by the SC or amended by Congress.

“Any power or authority granted by the law to Department of Justice and Secretary of Justice will be exercised judiciously and prudently, within the standards or parameters set forth in the law and with due regard to fundamental, human rights of individuals.”

De Lima further said that the DoJ will create a new office to prosecute cybercrimes identified in the law to be manned by 100 state prosecutors who have been trained on cyber forensics.

Under this law, the DoJ has the authority to restrict or block access to computer data found to have prima facie violation of cybercrimes defined in RA 10175.
